From the 1st of January 2010 the Queensland Government requires a new “Sustainability Declaration” be completed for all residential properties that are for sale.

The Sustainability Declaration is a checklist to assess the properties environmental and social sustainability with regard to energy efficiency, water conservation, general safety and access to the property.

It is designed to increase the awareness of the sustainability features included in a property and increase the sustainability performance of Queensland homes. The Sustainability Declaration must be made available to any prospective buyer who requests it, reference must be made to it in nearly all marketing and it must be on display at open for inspections.

The legislation has only been introduced in November 2009 and currently our office is working to ensure that all our sellers are in a position to meet their obligations under the new laws. Failure to comply can mean fines of up to $2,000 for you and $10,000 for our agency. In this light we are doing everything we can to ensure compliance. Failure to comply will mean we are forced to remove your property from the market.

Our office has sent out these Declaration forms for all current clients, we urge those sellers to return the declaration to our office in person, by mail, fax or email as soon as possible. More information can be found at the Department of Planning and Infrastructure website.
